Privacy Notice

Thank you for visiting the website of FBME Bank Limited – Cyprus Branch (Under Liquidation) (“FBME”). FBME aims to protect the privacy of your personal data. This website is intended, primarily, to provide the creditors of FBME and other interested parties, with all information relating to the liquidation thereof.

For the purposes of this Privacy Notice, personal data is any information that relates to an identified or identifiable natural person.

Mr. Petros Ioannides, who is the appointed liquidator of FBME in Cyprus following an order of the District Court of Nicosia dated 29/06/2023, is the data controller (the “Liquidator”, the “Controller”). This means that the Liquidator decides how your personal data is used, processed, stored and handled, as well as the means of processing.

Special categories of data

FBME will not process special categories of data, including data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation without your prior explicit consent where this is necessary, unless otherwise required and / or enforced by law.

Purposes of processing and legal basis

The processing of personal data via the use of the FBME Website is based on the legal obligations which the Controller has acquired pursuant to his appointment by the District Court of Nicosia as the liquidator of FBME and he is now obligated to exercise the powers vested in him by the said Court. At the same time, as an insolvency practitioner and as a liquidator appointed for this specific task of liquidating FBME, he is subject to a number of obligations under the law. Therefore, it is necessary for your personal data to be processed in the context of the Liquidator carrying out his duties and legal obligations towards FBME’s creditors, employees, to the Court and under applicable law.

If you do not provide FBME with the data required for the Liquidator to carry out his legal obligations and duties, including to prove and/or confirm FBME’s debts and amounts owed to its creditors, then the Liquidator shall proceed with carrying out his duties to the best of his abilities and in this context, as if the creditors who do not provide the necessary data, have waived their right to receive any debts and/or funds owed to them by FBME.

Personal Data Disclosure

The Liquidator is a partner of BDO Cyprus, which is a member of the global BDO network. The Liquidator shall utilize the BDO Cyprus services, employees, professionals, and global network to carry out the liquidation process. FBME does not disclose your personal data to third parties, except for the purposes described herein. Third party disclosures may include sharing such personal data with BDO Cyprus, the BDO global network or with non-affiliated companies that perform support services for your account or facilitate your transactions with us, including those that provide legal advice to us. The transfers between firms of the BDO global networks are governed by BDO’s binding corporate rules for processors and controllers, available here.

In addition, FBME may provide your details to other banking institutions which either hold deposits for and on behalf of FBME as correspondent banks or to which the Liquidator retains specific collection accounts in which the funds are collected for distribution to the creditors, or to other public authorities if so required for the Liquidator to carry out his legal obligations and duties effectively.

In any event, prior to sharing your personal data with third parties, we take appropriate measures to make sure that such third parties keep your personal information secure.

Should it be required that your personal data is transferred outside the EEA, FBME shall implement appropriate transmission mechanisms in accordance with the law and will inform you in advance.

Your rights

You have the right to withdraw your consent for FBME to use your personal data for the purposes described above at any time, but the lawfulness of processing based on consent before its withdrawal is not affected.

You further have a number of rights as regards the processing of your personal data by FBME, namely:

  • Right to Accessing and updating your personal information.

You have the right to access your personal data at any time to check whether it is accurate and up-to-date. Such right can be exercised by contacting FBME as indicated in the “Contact Us” section. FBME will provide you with a copy of the information free of charge and without undue delay.

  • Right to erasure

You have the right to obtain from us the erasure of your personal data concerning you without undue delay where:

  • the personal data in question are no longer necessary in relation to the purposes for which they were collected; or
  • you withdraw your consent on which the processing is based and where there is no other legal ground for the processing; or
  • the personal data have been unlawfully processed; or
  • the personal data have to be erased for compliance with a legal obligation to which FBME is subject;
  • Right to portability

You have the right to receive the personal data concerning you, which you have provided to FBME, in a structured, commonly used and machine-readable format.

  • Right to object

You have a right to object to the processing of personal data concerning you where, among others, the processing is carried out in the public interest, or on the grounds of the legitimate interests of FBME or a third party, or for direct marketing, including profiling.

  • Automated individual decision-making, including profiling

You have the right not to be subject to a decision based solely on automated processing, including profiling, unless the decision is necessary for entering into or performing a contract between you and FBME; is authorised by European Union or Cypriot Law; or is based on your explicit consent.

Data Retention

In the absence of any predetermined retention period required under legislation to retain any of your personal data, your personal data will only be retained for as long as necessary for fulfilling the purposes of processing. After that period, we will securely delete your personal data using all appropriate legal and technical measures.
